Everstrong Leadership Terms of Use
Everstrong Leadership, a division of Everstrong Media, LLC (“Everstrong Leadership”, “we”, or “our”), provides proprietary leadership development research, tools, materials, and related advisory services to our clients via our website and digital platforms (collectively, the “Services”). A “Client” is defined as the entity that has purchased our services. These Terms of Use shall be referenced in a signed service agreement (“Service Agreement”) between the Client and Everstrong Leadership.
Your use of our website or Services, whether as a Client or authorized user (“User”), constitutes acceptance of these Terms of Use.

1. General Use Restrictions
The Services are for internal use and benefit by the Client and authorized Users, subject to the terms and limitations of the paid subscription. Services may not be disclosed, disseminated, or distributed to any third party unless otherwise agreed in writing by Everstrong Leadership.
Users may not:
• Circumvent access restrictions or encryption.
• Upload or transmit any illegal, harmful, or offensive material, including but not limited to viruses, worms, spyware, unsolicited messages, or libelous content.
• Use the Services for any unlawful or improper activities.
2. Copyright & Intellectual Property
The Services are © Everstrong Media, LLC. All rights reserved.
All content, templates, tools, and intellectual property provided via our Services are the exclusive property of Everstrong Leadership or its licensors. These materials are protected by U.S. and international copyright and trademark laws.
Users may:
• Download and internally use templates and tools within the Client organization.
• Make a single copy of slides, charts, or tables for internal presentations with attribution.
• Share training materials and derivative works internally, but not for resale or external distribution.
Users may not:
• Resell, sublicense, or publicly share our content.
• Post content on external sites or use it to develop competing products or generative AI training.
• Use Everstrong Leadership’s name to promote unrelated products/services without written consent.
3. User Access
Access to the Services is restricted to authorized Users. Users must safeguard their credentials and notify us immediately at info@everstrongleadership.com or (804) 223-2723 if credentials are compromised.
Consultants and contractors may only use the Services to benefit the Client who engaged Everstrong Leadership.
4. User Contributions
Everstrong Leadership may invite users to participate in research and forums or submit content (“User Contributions”). By contributing:
• You retain responsibility for the accuracy and legality of your content.
• You grant Everstrong Leadership a worldwide, irrevocable, royalty-free license to use, display, and publish your contributions.
• You agree not to post offensive, unlawful, or infringing content.
We reserve the right to monitor, reject, or remove contributions that violate our policies.
5. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged. Exceptions include:
• Publicly known information.
• Information disclosed under legal requirement or with written consent.
• Anonymized benchmarking data, which Everstrong Leadership may use for research and analysis.
Clients affirm they have legal authority to share employee or organizational data with us as part of the Services.
6. Term
Subscriptions are valid for the duration stated in the Service Agreement and must be renewed to maintain access. Unless otherwise stated, workshops or add-ons must be used within the applicable term or one (1) year of purchase.
We may revoke access if the Client or User violates any term.
7. Cancellation
Service Agreements may not be terminated for convenience. However, Clients may cancel if:
• Services are materially changed or discontinued,
• Such changes impact the Client’s ability to use the Services,
• And Everstrong Leadership cannot remedy the issue within 20 business days of written notice.
8. Service Changes
We may update or improve features to enhance user experience. Such changes will not degrade the overall value of paid Services. Use of the Services after changes constitutes acceptance.
9. Accuracy and Warranty Disclaimer
Services are based on reliable sources and expertise; however:
• We do not guarantee absolute accuracy or completeness.
• Content is not intended as legal or professional advice.
• Services are provided “as is” with no warranties—express or implied.
• We do not guarantee the Services are free from viruses or other harmful components.
Clients are encouraged to consult appropriate professionals before acting on any insights provided.
10. Non-Solicitation
Clients agree not to recruit or hire Everstrong Leadership employees for two (2) years after the term of any Service Agreement, without prior written consent.
11. Limitation of Liability
Everstrong Leadership is not liable for indirect, incidental, or consequential damages, including business losses or lost profits. Our total liability shall not exceed the amount paid for the relevant Service.
These limitations reflect the basis on which our Services are priced and provided.
12. Third-Party Links
We may link to third-party websites for convenience. We do not control or endorse those sites and are not liable for their content or policies.
13. Investment Advice
Our Services are not designed for investment decision-making or securities analysis. We are not responsible for any investment actions taken based on our content.
14. Governing Law
These Terms and any disputes are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-law rules. Any disputes shall be resolved in the courts located in Virginia.
15. Entire Agreement
These Terms and any signed Service Agreements or Statements of Work constitute the entire agreement and supersede all prior discussions or proposals.
16. Privacy
Your privacy is important to us. Please have a look at our Privacy Policy for details on how we collect and use data. We may disclose clients' names for promotional purposes unless otherwise agreed.
